3.2 We may process photographic data during the course of carrying out our business. This data may include photographs of members of the public and uninvolved persons in which said persons are identifiable. The source of this data is on-site photography via drone (UAS) or other camera device. In all cases, this data processing will be incidental and an unavoidable consequence of carrying out our legitimate business interests of carrying out building and site photography for the purposes of creating computer generated imagery (CGIs).
4. Purposes of processing and legal bases
4.1 In this Section 4, we have set out the purposes for which we may process personal data and the legal bases of the processing.
4.2 Operations - We may process your photographic data for the purposes of creating computer generated imagery (CGIs). The legal basis for this processing is our legitimate interests, namely the proper administration of our services and business.
5. Providing your personal data to others
5.1 Whilst we may collect and process your photographic data during the course of our legitimate business interests, our purposes are architectural visualization and the creation of computer generated imagery, and therefore the collection of photographic data from members of the public is purely incidental. Our focus is buildings, not people. Therefore, if we do in the process of carrying out our legitimate interests acquire and process your data through your being visible in photographs taken, these photographs will never be shared or distributed without all identifiable persons first being removed from the frame either through cropping or blurring/pixelation of the relevant section of the image[s] using third-party software.
5.2 Your personal data held on our cloud-based, password protected and encrypted server hosted by Microsoft OneDrive.
5.3 We will not disclose your photographic data to our clients or the public.
5.4 In addition to the specific disclosures of personal data set out in this Section 5, we may disclose your personal data where such disclosure is necessary for compliance with a legal obligation to which we are subject, or in order to protect your vital interests or the vital interests of another natural person. We may also disclose your personal data where such disclosure is necessary for the establishment, exercise, or defence of legal claims, whether in court proceedings or in an administrative or out-of-court procedure.
6. Retaining and deleting personal data
6.1 This Section 7 sets out our data retention policies and procedures, which are designed to help ensure that we comply with our legal obligations in relation to the retention and deletion of personal data.
